Page title: Terms and Conditions · Shopify slug: terms-of-service
1. Scope
(1) These Terms and Conditions ("Terms") regulate all agreements entered into through the online shop at lumixy.com between the operator of lumixy.com (hereinafter "LUMIXY", "we", "us") and the shopper (hereinafter "you", "Buyer"). Our range encompasses items in the home and garden categories.
(2) A consumer within the meaning of these Terms is any natural person concluding a legal transaction for purposes that are predominantly unconnected to any commercial or self-employed professional activity. A business buyer is any natural or legal person, or a partnership with legal capacity, acting in the exercise of their trade or independent professional activity when the contract is formed.
(3) Any deviating, conflicting or supplementary conditions put forward by the Buyer shall only become part of the agreement if their validity has been expressly acknowledged by us in writing.
2. Contracting Party and Contact
The contract of sale is formed between you and the operator of LUMIXY. Complete provider particulars are set out on our Legal Notice page.
Customer support: contact@lumixy.com
3. Conclusion of Contract
(1) The listing of our home and garden merchandise in the online shop does not constitute a legally binding offer; it functions solely as a non-binding online catalogue.
(2) By clicking the "Buy" / "Place order" / "Pay now" button, you submit a binding offer to acquire the items in your shopping basket.
(3) Acknowledgement of receipt and acceptance of your order occur simultaneously — you will receive both immediately after submitting your order by way of an automatically generated email. Upon despatch of this confirmation email, the contract of sale becomes legally binding.
(4) We retain the contract text and forward it to you together with these Terms by email. The current version of the Terms is also accessible at any time at lumixy.com/terms-of-service.
(5) Contracts are concluded in the English language.
4. Prices and Shipping Costs
(1) All prices stated on the website include the applicable statutory Value Added Tax. Any delivery charges are shown separately during the checkout process.
(2) For shipments to destinations outside the European Union and the United Kingdom, customs duties, local taxes and further levies may apply; these are the sole responsibility of the Buyer.
(3) Full details of shipping charges and estimated delivery windows are available on our Shipping & Payment page.
5. Payment Terms
(1) The following payment methods are available: credit card (Visa, Mastercard, American Express), PayPal, Klarna, Apple Pay, Google Pay and bank transfer. We reserve the right to exclude individual methods in specific circumstances.
(2) The full purchase price is due upon conclusion of the contract.
(3) Where payment is made by credit card or PayPal, your account will be debited immediately upon completion of the order.
6. Delivery
(1) Goods are sent to the delivery address supplied by the Buyer. Applicable delivery windows are shown on each product page and throughout the checkout process.
(2) Should delivery prove impossible after three attempts, we are entitled to withdraw from the contract. Any sums already paid will be refunded without delay.
(3) Where force majeure causes delays, the delivery period will be extended proportionately. We will inform you of any such circumstances as swiftly as possible.
7. Retention of Title
All despatched goods remain our property until full payment of the purchase price has been received.
8. Right of Cancellation for Consumers
Consumers hold a statutory right of withdrawal. Full cancellation details and the model withdrawal form can be found on our Cancellation Policy page.
9. Warranty and Liability for Defects
(1) The statutory provisions on defect liability apply. For consumers, the limitation period for defect-related claims is two years from the date of delivery.
(2) For second-hand goods, this period is reduced to one year from delivery.
(3) Should any item arrive faulty, please contact us at contact@lumixy.com.
10. Liability
(1) We accept unlimited liability in cases of intent and gross negligence, and within the framework of applicable consumer protection legislation.
(2) In cases of ordinary negligence, our liability is restricted to breaches of a material contractual obligation whose fulfilment is essential to the proper performance of the contract and upon which the Buyer may reasonably rely. In such instances, liability is capped at the level of foreseeable, contract-typical loss.
(3) Liability for injury to life, limb or health remains unaffected by the above.
11. Dispute Resolution
(1) The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.
12. Applicable Law and Jurisdiction
(1) The contractual relationship is governed exclusively by the laws of England and Wales, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only insofar as the protection afforded by mandatory provisions of the consumer's country of habitual residence is not thereby removed.
(2) Where the Buyer is a merchant, a body corporate under public law or a public-law special fund, the courts at our registered office shall have exclusive jurisdiction over all disputes arising from this relationship.
13. Final Provisions
Should any provision of these Terms be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected. The relevant statutory rule shall replace any void provision.
